Welcome to King James Projects ("we", "our", "us"). These Terms and Conditions govern your use of our website, services, and any agreements related to hot asphalt surfacing, paving, driveway construction, road marking, speed humps, swimming pools, sports courts, kerb installation, landscaping, and related construction services in South Africa.

2. Our Services

King James Projects specialises in the following construction and surfacing services:

3. Quotations and Pricing

3.1 Free Quotes

We provide free, no-obligation quotations for all our services. Quotes are valid for 30 days from the date of issue, unless otherwise stated.

3.2 Pricing

• All prices quoted are in South African Rand (ZAR) and include VAT unless stated otherwise.
• Pricing is based on the information provided at the time of quotation. If site conditions differ materially from what was reasonably anticipated, we reserve the right to adjust the quote accordingly.
• Additional work requested by the client after the project has commenced will be quoted separately and requires written approval before proceeding.

3.3 Price Changes

Material costs and exchange rates can fluctuate. If there is a significant increase in material costs between the quote date and the project start date, we may need to adjust the price. We will notify you in writing before any price adjustment takes effect.

4. Bookings and Deposits

4.1 Deposit Requirement

For most projects, a 30% – 50% deposit is required to secure your booking and order materials. The exact deposit amount will be specified in your quotation.

4.2 Payment Terms

• Deposit: Due upon acceptance of quote to secure your place in our schedule.
• Progress payments: For larger projects, staged payments may be required.
• Final payment: Due upon completion of the work, before handover.

4.3 Accepted Payment Methods

We accept EFT (electronic funds transfer), direct bank deposit, and verified business cheques. Credit card facilities are available by prior arrangement.

5. Cancellation and Refund Policy

5.1 Cancellation by Client

• More than 14 days before start date: Full refund of deposit, minus an administrative fee of R500.
• 7–14 days before start date: 50% of deposit refunded.
• Less than 7 days before start date: Deposit is non-refundable, as materials and scheduling have been committed.
• After work has commenced: No refund for work completed. Client is responsible for payment for work done plus materials ordered.

5.2 Cancellation by King James Projects

In the unlikely event that we need to cancel your project due to unforeseen circumstances (e.g., extreme weather, equipment failure, staff illness), we will:

• Notify you as soon as possible.
• Offer to reschedule at a mutually convenient time.
• If you prefer not to reschedule, provide a full refund of any deposits paid.

6. Site Preparation and Client Responsibilities

To ensure a smooth project, clients agree to:

• Access: Provide clear access to the work area for our vehicles and equipment.
• Utilities: Identify and mark any underground cables, pipes, or services before excavation begins. King James Projects is not liable for damage to unmarked services.
• Obstructions: Remove vehicles, furniture, or other obstacles from the work area.
• Neighbours: Notify neighbours if the work may cause noise or access disruption.
• Permits: Obtain any necessary municipal approvals or body corporate permissions (we can assist with this process).

7. Warranties and Guarantees

7.1 Workmanship Warranty

We stand behind our work. King James Projects provides a 5-year workmanship warranty on all asphalt and paving installations, covering defects directly related to improper installation. This warranty does not cover damage caused by:

• Subsidence or ground movement outside our control.
• Tree root intrusion.
• Heavy vehicles or loads beyond normal residential use (unless specifically designed for commercial use).
• Chemical spills, oil leaks, or staining.
• Normal wear and tear.

7.2 Material Warranties

Materials supplied by third-party manufacturers are covered by the manufacturer's warranty. We will assist in facilitating any warranty claims, but the warranty is ultimately between the client and the manufacturer.

7.3 Making a Warranty Claim

To make a warranty claim, contact us within 30 days of discovering the issue. Provide photos and a description of the problem. We will inspect the work and, if the issue is covered, repair it at no cost to you.

8. Website Use and Intellectual Property

8.1 Content Ownership

All content on our website, including text, images, logos, and videos, is the property of King James Projects and is protected by South African copyright laws. You may not reproduce, distribute, or use our content without written permission.

8.2 Accuracy of Information

We strive to keep our website accurate and up to date. However, we do not guarantee that all information is error-free, complete, or current. Project photos are examples of previous work and may not exactly represent your project outcome.

8.3 Third-Party Links

Our website may contain links to external sites. We are not responsible for the content or practices of those websites.

9. Limitation of Liability

To the maximum extent permitted by South African law, King James Projects shall not be liable for:

• Any indirect, incidental, or consequential damages arising from the use of our services.
• Delays caused by extreme weather, supplier issues, or other events beyond our reasonable control.
• Damage to underground services that were not clearly marked by the client.

Our total liability for any claim related to our services shall not exceed the contract value paid by the client.

10. Dispute Resolution

10.1 Governing Law

These Terms and Conditions are governed by the laws of the Republic of South Africa.

10.2 Informal Resolution

If a dispute arises, both parties agree to first attempt to resolve it informally through good-faith negotiations.

10.3 Mediation

If informal resolution fails, the parties agree to submit the dispute to mediation through the Association of Arbitrators (Southern Africa) or a mutually agreed mediator.

10.4 Jurisdiction

Any legal action not resolved through mediation shall be brought in the Magistrate's Court of Gauteng, or the High Court of South Africa if the claim exceeds that court's jurisdiction.

11. Force Majeure

King James Projects shall not be liable for any delay or failure to perform due to events beyond our reasonable control, including but not limited to:

• Extreme weather (heavy rain, storms, extreme heat affecting asphalt application)
• Labour strikes or industrial action
• Supplier delays or material shortages
• Acts of God, natural disasters, or pandemics
• Civil unrest or government actions

12. Privacy

Your privacy is important to us. Please refer to our separate Privacy Policy for information on how we collect, use, and protect your personal data, in compliance with POPIA.

13. Changes to These Terms

We may update these Terms and Conditions from time to time. The "Last updated" date at the top of this page indicates when changes were made. Continued use of our services after changes constitutes acceptance of the updated terms.
